2.2 Metres in the Side and Rear Yard, Posts Excluded

Fence and Pool Enclosure By-law 2013-168-RE, consolidated in November 2020, permits 1.0 metre in a residential front yard and 2.2 metres in interior side, exterior side and rear yards. On non-residential property the interior and rear allowance rises to 3.0 metres with the front still at 1.0 metre.

The measurement definition is as useful as the number. Grade means the finished ground at the base of the fence, excluding an artificial embankment, and height is measured from the grade directly below the fence portion to its top — excluding posts. That is why a decorative post cap or a taller post does not, on its own, put a Stouffville fence over the limit.

Sight triangles are defined as 5 metres along each intersecting street line, and within one a fence or planting may not exceed 1.0 metre above the grade of either street. There are also useful special cases: outdoor-storage screening between 2 and 3 metres, and rear-yard tennis-court chain link permitted up to 3.6 metres.

The Repair Clause, and What It Lets You Keep

Whitchurch-Stouffville's by-law says a lawful pre-existing fence may be maintained and repaired at the same location, height and dimensions. Replacement or substantial alteration has to comply with the current by-law. That distinction is worth real money on an older Stouffville property whose fence would not be permitted if it were built today.

It is also the reason we quote repair and replacement as genuinely separate options here rather than defaulting to a rebuild. If your existing run is lawful and structurally repairable, keeping it may preserve a height or a position you could not re-establish.

If a plan does not comply, the Chief Building Official may consider a minor deviation and Council a larger variance. The current fees are $330 for a staff fence variance and $650 for a Council fence variance, set by Fees and Charges By-law 2025-079-FI.

Rural Servicing, Agricultural Uses, and Regulated Land

The Town's own design guidance confirms that some privately serviced residential lots run on private wells and septic systems, and that wooded and open-space contexts carry additional site-review considerations including conservation authority involvement where environmental designations apply.

That matters directly to a pool enclosure here: the Town charges $260 for a pool enclosure permit and an additional $190 review charge where the on-site sewage review is required. On a septic property, the enclosure line is a servicing decision before it is a fencing one.

The by-law also carries a narrow agricultural allowance. Electric fencing is prohibited except to contain animals in connection with agricultural uses in rural areas. Barbed and razor wire are prohibited except in the specified Employment Heavy context, where the wire must sit at least 1.8 metres above grade. There is no blanket exemption that removes a working farm from the height rules.

That makes the repair-or-replace decision more consequential here than in most municipalities. If your existing fence is lawful and structurally sound enough to repair, rebuilding it may mean losing a height or a position you cannot get back. We assess that before recommending a full replacement.

The pool enclosure permit is $260 in 2026. The Town also identifies an additional $190 review charge where the relevant on-site sewage review is required, which applies on privately serviced properties.

The enclosure itself must be at least 1.5 metres, measured on the outside. Gates must be self-closing, lockable and self-latching, with the opening device at the top of the gate and not readily operable from outside by a small child. No opening within or below the enclosure may pass an object greater than 100 millimetres; chain-link mesh is limited to 40 millimetres and prescribed vertical wood-board spacing to 40 millimetres. Where water is used during construction, the prescribed temporary enclosure must be in place before any water is introduced.

One caution worth raising: on covered hot tubs and spas, the Town's current webpage and the consolidated by-law do not read the same way. Section 8.13 of the by-law says a qualifying above-ground hot tub, whirlpool, pool or spa fitted with the prescribed substantial, locked cover need not comply with the enclosure-permit provision, while the webpage directs owners more broadly to apply. If you are relying on a cover rather than a fence, confirm your specific case with the Town before you build.

The Town's Division Fence By-law 2007-118-RE states that the Line Fences Act does not apply except for section 20, so the provincial fence-viewer process is not the route here.
