Four Different Height Limits in One Newmarket Backyard
Fence By-law 2019-20, as consolidated and amended by 2023-36, sets residential limits of 1.0 metre in a front yard, 1.8 metres in an interior side yard, 1.8 metres in an exterior side yard, and 2.1 metres in a rear yard. Four numbers, not one.
There are two further rules that catch people. On a corner lot, a rear fence that abuts the front or interior side yard of the adjacent lot is held to 1.8 metres rather than 2.1. And where a rear lot line abuts an arterial road, the fence may go to 2.4 metres — the one place in Newmarket where a genuinely tall fence is permitted outright.
Newmarket also defines daylighting triangles precisely: 5 metres along each intersecting lot line at a corner, and 5 metres along the lot line and driveway as prescribed for driveway triangles. Those are the dimensions we lay out on site before setting a corner post.

How Newmarket Measures Height, and Why It Matters on a Slope
Height in Newmarket is measured from the highest grade on either side of the fence, at a point less than 0.6 metres from the fence. On a lot where your side sits lower than your neighbour's, the measurement is taken from the higher side — which means the fence you see from your yard can legitimately be lower than the number in the by-law.
Where a fence sits on a retaining wall, the definition starts the measurement from the top of the wall. That single line decides a large share of the over-height fences we are called to correct in Newmarket, because a 1.8 metre fence on a 0.6 metre wall is not a 1.8 metre fence.
The by-law prohibits barbed wire, chicken wire and other barbed or sharp materials, along with specified sheet and corrugated materials and electrification. Fences must be maintained in good repair, which is the provision that turns a leaning run into an enforcement matter rather than a cosmetic one.

Those are measured dimensions, not judgement calls, so on a corner lot we lay the triangle out on site before setting the corner post. It is far cheaper than moving a completed run.
No. Under Newmarket's Pool Enclosure By-law 2008-18, the pool must not be filled until the enclosure meets the by-law, an officer has been notified, and the enclosure has been inspected and approved by the Town.
The enclosure itself must be at least 1.22 metres, measured from effective ground level on the outside. Gates must be self-closing, with a self-latching mechanism at least 1.22 metres above established grade and inaccessible from the pool side, plus a locking device. Clearance under the fence is limited to 100 millimetres and openings are generally limited to 38 millimetres, with a defined exception allowing up to 100 millimetre openings on an enclosure at least 1.52 metres high whose horizontal members are at least 1.22 metres apart. The fence or gate must generally sit at least 1.22 metres back from the water's edge.
Temporary fencing during construction must be at least 1.22 metres, rigid, and secured at openings when unattended. A permit is required before construction, including for a hot tub even where the compliant lid option is used. Permit fees are set by the Town's current fees by-law, so we confirm the amount with the Town at application rather than quoting a figure that may have changed.
Newmarket has opted out of the Line Fences Act except for section 20, so the provincial fence-viewer process does not apply here. Instead the Town has its own Division Fence By-law 2019-21, which governs the construction, replacement and repair of division fences.
